Town of Wise Planning Commission Public Hearing

The Town of Wise Planning Commission will hold a public hearing on a proposed amendment to the Town of Wise Zoning Ordinance and Subdivision Regulations, adopted March 23, 1987 at their regularly scheduled meeting on Monday April 1, 2019 at 6:00 p.m. in Council Chambers of the Wise Municipal Building, 501 West Main Street, in Wise. Mobile food units usually refer to a food service establishment that is vehicle-mounted or wheeled and is capable of being readily moveable.
When the public hearing is opened, you or your designated representative may make public comment on the proposed Zoning Ordinance amendment.  The proposed amendment would amend Article 4, Section 5.2 to allow Mobile Food Units in the B-2 General Business Zoning District and Article 4, Section 8.2 to allow Mobile Food Units in the B-3 Central Business Zoning Districts subject to the special regulations for Mobile Food Units as listed on our website at www.wswv.net.
Must be located on commercially used, private property unless part of an approved special event for no more than three consecutive calendar days and no more than five calendar days per month.
Location must be approved by Town Council prior to locating on Town of Wise property.
Mobile food units must be located a minimum of 100 feet from a residential zoning district.
Mobile food units must be located a minimum of 100 feet from a bricks and mortar restaurant.
Mobile food units may not block sidewalks.
Mobile food units must be registered and have a current, valid license from the Virginia Department of Health.
Mobile food units must have a current fire inspection certificate.
Mobile food units must provide Town with a copy of certificate of insurance.
Mobile food units must register with the Town of Wise Treasurer’s Department and, when applicable under Virginia Code, obtain proper business license and pay applicable Meals Tax of the Town of Wise Treasurer’s Department by the due date of the following month in which Mobile food unit set up in the Town of Wise.
Mobile food units setting up with an approved special events application are exempt from these zoning regulations.
Following the public hearing, the Planning Commission may recommend that Town Council adopt the above-mentioned amendments to the Town of Wise Zoning Ordinance and Subdivision Regulations.A copy of the Town of Wise Zoning Ordinance and Subdivision Regulations is on file in the Town Planner’s office at the Wise Municipal Building where it may be examined by interested parties during regular business hours.
